The Role of The Legacy Project:

The Legacy Project is a specialized service where the death doula, as both a compassionate guide and artist, works with a dying person to explore and honor their life. This service culminates in the creation of a meaningful art piece that symbolizes the client’s legacy, to be cherished by them and their loved ones.

This agreement is between Tess Bloomer, referred to as “Doula,” and [Name of Client and/or Family Member Hiring], referred to as “Client.”

Services Provided:

The Legacy Project offers two options, both designed to create a lasting tribute to the Client’s life:

  1. Commissioned Portrait:

    • A 2-hour visit where the Client’s legacy is discussed in depth and a plan for a commissioned portrait is finalized.

    • The Doula will submit 1-2 sketches for the painting to be approved by the Client.

    • The Doula will complete a custom portrait upon an agreed deadline.

    • The completed portrait will be presented to the Client and their loved ones in a private gathering or vigil.

  2. Collaborative Art Piece:

    • A 2-hour visit where the Client and Doula discuss the Client’s legacy and co-create a plan for an art project and its presentation.

    • In four 2-hour visits (or a total of 8 hours), the Client and Doula will collaborate to create a meaningful art piece that honors the Client’s legacy.

    • The Doula and Client will present the finished artwork to the Client’s loved ones in a private gathering or vigil.

Service Details:

  • Initial Visit: A 2-hour session focused on discussing the Client’s life, legacy, and wishes for the art project.

  • Art Creation: Depending on the chosen option, either the Doula will create a painted commissioned portrait, or the Doula and Client will work together on an art piece.

  • Final Visit: The finished art project will be presented to the Client and their loved ones in a celebration of the Client’s legacy. This meeting may serve as a type of vigil, with details discussed upon first visit.

Ownership and Rights:

  • The completed art piece will be owned by the Client and/or their loved ones.

  • The Doula retains the right to use images of the artwork for portfolio purposes, with the Client’s consent.

Fees:

The total fee for the Commissioned Portrait service is [$1,200]. This fee covers:

  • The initial visit to discuss and finalize the project plan.

  • The creation of the [18’’x18’’ acrylic portrait] art piece.

  • The final visit and presentation of the completed work to the Client and their loved ones.

The total fee for the Collaborative Art Piece service is [$800]. This fee covers:

  • The initial visit to discuss and finalize the project plan.

  • The art supplies and [4] visits to create the art piece.

  • The final visit and presentation of the completed work to the Client and their loved ones.

Limitations:

  • The Doula is not a replacement for medical care and will not administer medication.

  • The Doula’s role in this service is both as an emotional and artistic guide, and does not replace any other professional services the Client may require.

Confidentiality:

The Doula will maintain confidentiality throughout the process, ensuring that all discussions and personal information shared during The Legacy Project remain private. Any sharing of the artwork for portfolio or promotional purposes will be done with the Client’s explicit consent.

Responsibility of Client:

  • The Client will provide the Doula with any necessary information about their life, legacy, and wishes for the art project.

  • The Client will inform the Doula of any significant changes that may affect the art project or the scheduled visits.

Cancellation or Failure to Provide Services by the Doula:

  • If the Doula becomes unavailable to complete the project after the Agreement is signed, they will notify the Client as soon as possible. If a suitable replacement Doula-Artist is available, the Client will have the option to proceed under the same terms.

  • If no replacement is available, the Doula will refund a percentage of the fee corresponding to the portion of services not yet provided.

Waiver of Liability:

As a condition of service, the Client agrees under [State] law to waive any rights, claims, or causes of action against the Doula now and in the future concerning the Client’s death or the services provided by the Doula. The Client understands that the Doula is not a medical professional and will not provide medical advice.

This Waiver of Liability is intended as a COMPLETE RELEASE AND DISCHARGE of all liability.
